Welcome to VoiceVibes. By accessing or using our voice analysis application ("Service"), you agree to be bound by these Terms of Service ("Terms"). Please read them carefully.

1. Acceptance of Terms

By creating an account, accessing, or using VoiceVibes, you agree to these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the Service.

2. Description of Service

VoiceVibes is an AI-powered voice analysis platform that:

• Records and analyzes your voice readings
• Provides scores and feedback on various vocal metrics
• Tracks your progress over time
• Displays user rankings on a public leaderboard

3. Account Registration

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate and complete information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access
• Be responsible for all activities under your account

4. Leaderboard and Public Display

By using VoiceVibes, you consent to having your name (first name and last initial) and best score displayed on our public leaderboard. This feature is integral to our Service and cannot be opted out of while maintaining an active account. If you do not wish to appear on the leaderboard, you must delete your account.

5. Subscription and Payments

VoiceVibes offers both free and premium subscription tiers:

• Free Tier: Limited to 3 voice recordings per account
• Premium Tier: Unlimited recordings for $4.99/month

Premium subscriptions are billed monthly through Stripe. You may cancel at any time through your account settings, and cancellation will take effect at the end of your current billing period.

6. Refund Policy

Due to the digital nature of our Service, refunds are generally not provided. However, we may consider refund requests on a case-by-case basis at our sole discretion. Contact us at support@voicevibes.ai for refund inquiries.

7. Right to Terminate

We reserve the right to suspend, terminate, or cancel any user account or subscription at our sole discretion, with or without cause, and with or without notice. Reasons for termination may include, but are not limited to:

• Violation of these Terms
• Abusive or inappropriate use of the Service
• Fraudulent activity or payment disputes
• Uploading harmful, offensive, or inappropriate content
• Attempting to manipulate scores or the leaderboard
• Any behavior we deem detrimental to the Service or other users

In the event of termination, you may lose access to your account data, history, and any remaining subscription period. We are not obligated to provide refunds for terminated accounts.

8. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose
• Upload recordings containing hate speech, threats, or inappropriate content
• Attempt to manipulate, cheat, or game the scoring system
• Share account credentials with others
• Reverse engineer or attempt to access our systems
• Use automated tools or bots to interact with the Service
• Interfere with other users' experience

9. Intellectual Property

The VoiceVibes name, logo, and all related content, features, and functionality are owned by VoiceVibes and are protected by copyright, trademark, and other intellectual property laws. You retain ownership of your voice recordings, but grant us a license to process and analyze them for providing the Service.

10. AI and Data Processing

Our Service uses artificial intelligence (including OpenAI's technology) to analyze your voice recordings. By using the Service, you consent to:

• Your voice recordings being processed by AI systems
• Your data being stored on secure cloud servers (Firebase)
• Analysis results being generated and stored

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We do not guarantee that:

• The Service will be uninterrupted or error-free
• AI-generated scores and feedback will be perfectly accurate
• The Service will meet your specific requirements

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VOICEVIBES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING FROM YOUR USE OF THE SERVICE.

13. Indemnification

You agree to indemnify and hold harmless VoiceVibes, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

14. Changes to Terms

We may modify these Terms at any time. We will notify users of significant changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the modified Terms.

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
